Roberto Carlos Munoz-Guatemala, age 39, a citizen of Mexico, is scheduled to face a jury beginning Monday, December 8, accused of a single felony count of assault of a federal officer.
He is scheduled to appear in federal court today in downtown St. Paul for a pre-trial hearing. The case is simple. On the morning of June 17, a multi-agency group of federal agents arrived at Munoz’ home in Bloomington intent on making an arrest. Munoz is an illegal alien with a prior felony conviction (sex crime involving his stepdaughter).
Agents conducted a traffic stop. using four (4) squad cars with flashing lights and sirens.
Munoz fled the stop, jumping the curb and dragging a uniformed agent more than 100 yards down the road. Afterwards, the officer had to be hospitalized.
In pre-trial filings, Munoz’ defense will rest on either (1) his alleged belief that he was being carjacked…by uniformed officers, using marked squad cars, or (2) that he was the victim of assault, having been tazed twice in the effort to apprehend him.
Also appearing in federal court today for a detention hearing is Ismael Chupin-Higuera, our Minnesota Man of the Day honoree for November 19.
