Confirming what we all know

Two key state officials overseeing the massive fraud scandals are serving while unconfirmed.

One of the most important responsibilities/powers of the Minnesota State Senate involves the confirmation of state executive branch officials.

Minnesota’s system is the opposite of the federal one: official begin serving as soon as they are nominated, and can continue to serve, unconfirmed, until fired by a vote of the full Senate.

The top officials (commissioners) of all the two agencies most involved in the fraud scandals are currently serving without Senate confirmation. In fact, I can’t see any evidence that any confirmation hearings have been held for either of the commissioners involved.

Democrats have controlled the Senate by a 34-33 margin since the last election in 2022.

Shirleen Gandhi is serving as “temporary” commissioner of the state Department of Human Services (DHS). According to senate records, Gandhi was formally nominated to the post on February 4, 2025. The Senate took no action on her nomination before adjourning for the year in May.

Likewise, Tiki Brown was appointed commissioner of the newly formed Dept. of Children, Youth, and Families (CYF) back in July 2024, yet the Senate has taken no action on her appointment in the year and a half since.

The state Senate won’t convene again until February 17, 2026.
