It’s been two days since the 8th circuit court of appeals dropped its bombshell decision overturning the basis used for releasing more than a thousand illegal aliens in Minnesota under habeas corpus petitions. The decision overturned a Minnesota case (File No. 25-cv-3741) decided by Judge John Tunheim, a Clinton appointee.
I’ll be tracking new habeas corpus cases filed in Minnesota that will play out under the new rules, plus the original Tunheim case that was remanded back to him by the 8th circuit.

So far, no filings made in these cases reflect the 8th circuit’s ruling. I would also note that two judges have set response deadlines for this weekend.

Ezequiel Rojas Gasca of Mexico should finally be heading home after completing his jail sentence for illegal re-entry of a previously deported alien.

Mr. Rojas earned Minnesota Dad of the Week honors back in July 2025, accused of the sexual abuse of his own five-year-old daughter, and having two earlier drunk driving convictions. He pled guilty to the illegal re-entry felony back in September.
Rojas was back in court earlier this week where a judge determined that the U.S. has hosted our Minnesota Dad for long enough. Adios!
Erick Jorge Diego Alvarez-Hernandez of Mexico will be staying with us a little bit longer.

He was sentenced this week to 1 year and 9 months in federal prison for his felony re-entry conviction, plus a separate conviction for failure to register as a sex offender. In this instance, his two child victims were not his own children. His sentence was at the exact midpoint of the sentencing guidelines.
Darwin Josue Noriega-Garcia Honduras will also be heading home soon. After pleading guilty to felony illegal reentry this week, he will reportedly be working as a truck driver in his native land.
