Local media discover the phenomenon that your correspondent has been reporting on for weeks. Of course, in their telling of it, habeas corpus is a fabulous thing.
So far this January, some 528 habeas cases have been filed with the federal district court of Minnesota. Each petition seeks to free one or more illegal aliens detained by ICE in their recent sweep, Operation Metro Surge.
From KARE 11-TV,
Habeas corpus petitions skyrocket over illegal detentions
KARE-11 reports,
Kira Kelley, another attorney representing immigrants in habeas corpus cases, says they are overwhelmingly successful.
“The vast majority of these are getting approved,” Kelley said.
Meanwhile, I am pleased to announce that Roberto Garcia De Leon is our Minnesota Man of the Week, for this final week of January.

Garcia is the featured arrestee in this press release from the U.S. Department of Homeland Security (DHS). From yesterday’s news release,
DHS Highlights More Criminal Illegal Aliens Including Pedophiles, Domestic Abusers, and Violent Assailants Arrested Yesterday in Minnesota.
Mr. Garcia apparently falls into the “pedophile” category. DHS writes of their top-billed get of the day,
Roberto De Leon-Garcia, a criminal illegal alien from Mexico arrested for second-degree criminal sexual conduct—contact under 14–and convicted of conspiracy to transport aliens within the U.S.
He made his first federal court appearance yesterday in downtown Minneapolis. He is charged with illegal re-entry of a previously deported alien, a felony crime.
According to the criminal complaint, Roberto Garcia De Leon, a/k/a Roberto Carreon Garcia, age 38, was arrested back in July in Anoka County on the felony sex charge, which is still pending. Anoka County refused to honor the ICE detainer.
Garcia was previously deported back to Mexico in June 2014. He had also been deported earlier (December 2013) following his conviction on the felony human trafficking charge.
At the hearing yesterday, the judge ordered Garcia released on $0 bond. It’s not clear if he is again roaming our streets or if he was taken back into ICE custody.
No further court dates have been scheduled, as of yet.
