Initial Appearances

Two illegal aliens appeared in federal district court in downtown Minneapolis this afternoon. Your correspondent was there.

Both defendants participated in the day’s proceedings with the help of a taxpayer-paid Spanish-language interpreter and a taxpayer paid attorney. Both will return to court next week for further proceedings,

Bryan Josue Bautista-Duarte, age 30, was first up this afternoon.

Mr. Bautista was indicted last week by a grand jury on two felony criminal counts of illegal return of a previously deported alien. He has three (3) separate prior felony convictions at the state level (in 2021, 2024 and 2025), for assault with a dangerous weapon and domestic assault. Both cases were out of Nobles County (Worthington). He was deported following the first felony conviction in May 2025.

In the January 2025 incident, Bautista was originally charged with four felony counts, but pled guilty to a single felony count. He received a stayed sentence and three years of probation.

In the July 2024 case, Bautista pled guity, received a stayed sentence, and was given four years of probation.

Duarte actually served some prison time for the 2021 felony conviction. He also has three (3) separate DANCO violation cases (misdemeanors) dating from 2020. One of the three 2020 cases was pled down from the original charge of felony criminal sexual conduct.

The case of Maria Lopez-Hernandez is far less dramatic, but repressents the rare instance of a Minnesota Woman.

She faces a federal criminal misdemeanor charge of illegal immigration out of the southern district of California. A hearing will be held next week to determine whether the case will remain here or retuned to California. She is also charged with a failure to appear for a hearing in the underlying case.
